On October 25^th, Partner Rich Kurz will speak at the American Conference Institute’s (ACI) 9^th Anniversary Paragraph IV Disputes Master Symposium in Chicago, IL.

His panel session is titled, “A 360 Degree Examination of Reverse-Payment Settlements: Non-Monetary Provisions, State Legislation, Expert Testimony, and Recent Litigation.” Eric Grannon, Partner, White & Case LLP; Tasha Francis Gerasmiow, Partner, Kirkland & Ellis LLP; and Ted Mathias, Partner, Axinn, Veltrop & Harkrider LLP will join him as panel speakers.

This session will explore recent trends in agencies’ and courts’ approach to reverse payments, settlement strategies from the perspectives of brands and generics, address antitrust concerns in structuring agreements, and highlight state legislation related to “reverse payment” patent settlements. Additionally, the discussion will touch on the adoption of similar legislation in other states, proper antitrust review standards, and the importance of compliance to avoid costly litigation and penalties, along with At-Risk Launch considerations.
